- ALL USE OF THE GeekABC WEBSITE, ITS SERVICES, AND ANY SERVICES OFFERED THROUGH US OR THE SITE IS SUBJECT TO THE TERMS OF THIS AGREEMENT AND THE POLICIES.
- Satisfaction Guarantee for Services:
GeekABC guarantees that users of its services receive full value for their money. While in most cases this means solving the user's problem, there may be instances in which the problem is not resolved. In such cases the user may not be billed.
- Limitation of Liability:
In no event shall GeekABC be liable to any person for any special, general, incidental, indirect, consequential, or punitive damages of any kind, including, without limitation, those resulting from negligent or criminal acts of third parties, loss of use, loss of data, lost profits, or computer hardware damage, in connection with any of its services, the GeekABC (including all information, services, and products that are referenced or linked to in the GEEKABC™ website), or any other information, documents, products, software, downloads, repair services, advice, and information provided by GeekABC or any of its third-party product or service providers, whether such person is advised of the possibility of such damages.
- Limited Warranty:
On all onsite Level0, Level1, Level2, Level3, Level4 and Level5 service call GeekABC gives 30 days warranty. All hardware warranty issues beyond the first 15 days of purchase from GeekABC Technician or authorize third party agent are handled directly between the customer and the manufacturer. Only give manufacture warranty received from the product manufacturer on software. GeekABC offers replacement or exchanges for defective parts during the first 15 days. Computer systems & laptops are warranted for 15 days from purchase date. During this time, GeekABC warranties products to be free from defects in material and workmanship under normal use and service. This warranty is contingent upon the proper use of the product in question and GeekABC does not in any way claim responsibility or can it be held liable for any injuries or damages sustained because of defective product, misuse, or negligence to any person(s) or properties. If the product incurs any physical damage, the warranty will be void. Parts found defective by GeekABC within the warranty period will be either repaired or replaced at the sole discretion of GeekABC. GeekABC is not responsible for any loss of data that may occur while equipment being repaired is in our possession. GeekABC is also not responsible for any part that fails while in our possession, unless that part is still under GeekABC warranty. For repairs of non-GeekABC systems and GeekABC out of warranty systems, we guarantee only that the parts installed by us will perform satisfactorily under conditions of normal usage for 15 days after date of repair. The Limited Warranty does not cover any losses or damages that may occur as a result of: A. Shipping or improper installation or maintenance not performed by GeekABC B. Misuse, neglect or improper environment C. Excessive or inadequate electrical power surges or other irregularities.
- Terms & Conditions of Sale Payment:
Invoices are due upon receipt and payable in accordance with the terms. An Interest charge of 1.5% per month will be added to all past due accounts. There is a $35 service charge for all returned checks. Should it become necessary for us to retain an attorney to make demand upon or collect any past due invoices or statements, the customer agrees to pay all costs of demand or collection, including attorney fees, recording fees and court costs, incurred by GEEKABC™, through all appeals, and bankruptcy proceedings, if any.
Returns /Refunds: With A 15% restocking charge plus $49 travel fee will be applied to all returned merchandise. There will be no returns/refunds after 15 days from the original purchase date.
- Force Majeure:
GeekABC will make every effort to keep its Web site and Products and Services operational. In the event GeekABC delivery of the Services is delayed, prevented, or otherwise made impracticable by reason of any acts of God, fires, floods, earthquakes, or other natural catastrophes; national emergencies, strikes, lockouts or other labor difficulties; computer "hacking" attack or computer virus; any law, order, regulation or other action of any governing authority; power outages, technical equipment failures, or any other cause beyond GeekABC ’s reasonable control, then GeekABC shall be immune from such delivery to the extent that it is delayed or prevented by such cause.
- Right of Refusal:
GeekABC reserves the right to refuse, suspend or terminate any of its services and products to any customer in its sole discretion, without notice. Reasons for refusing service include, but are not limited to: using computer system fraudulently, illegally, or for propagating libelous or otherwise defamatory, obscene, pornographic, abusive, harassing or threatening material.
- Internal Complaint Policy Statement:
We are committed to your satisfaction and have procedures in place to provide you with a fair, timely and effective means to resolve problems with any transaction. GeekABC is not responsible of any computer(s), hardware(s), software(s), data or any customers item(s) which not been schedule by customer for drop off at the customers location for more than 15 days since the last serviced. We record and monitor all complaints. We will undertake to acknowledge any complaint within seven Business days of receipt and will strive to address and have a resolution of complaint within 45 days of receipt. - Privacy and Security Policy:
GeekABC recognizes and respect customers’ privacy. Accordingly, we have procedures intended to ensure that your personal information is handled in a safe, secure, and responsible manner. When an order is placed on our web site, all information is used by GeekABC with the sole purpose of processing customer's orders and improving Buyer's website experience. Buyer can be certain that GeekABC will never sell customer's information to third parties. GeekABC might use this information to notify customers about new product releases and special offers upon request. In the event customer do not wish to receive the order status, follow-up and tracking number emails as well as any promotional e-mail from GeekABC , please contact us at firstname.lastname@example.org requesting us to suspend emails. - The GeekABC Security Guarantee:
We guarantee that your online transaction will be secure, and that your credit card information will be protected. In the unlikely event that unauthorized charges are made on your credit card, through no fault of your own, resulting from purchases made on GeekABC ’s website utilizing our secure servers, GeekABC will reimburse you for any and all amounts you are required to pay by the credit card issuer.

- Credit Cards:
GeekABC accepts VISA, MasterCard, American Express and Discover cards issued in the US and Canada. Please provide the exact billing address and telephone number information as your credit card bank has on file for you.
- Bank Wire-Transfers:
Orders are released upon bank confirmation of wire transfer. Please allow 2 to 5 Business days for the wire transfer to clear. Call GeekABC for bank information.
- Sales Taxes
GeekABC charges sales taxes on all parts, for any sales tax exemption, please fax your Exemption Certificate to us 24 hours before service call. All partner of GeekABC charge applicable taxes at the respected states.
- Supplemental Terms for Additional and/or Products and Services:
- The terms of the Agreement, in addition to the supplemental terms identified below, apply to the applicable add-on product or service that may be made available by GeekABC.
Terms of Agreement; Modifications: You agree that GeekABC may modify this Agreement and the Services from time to time. You agree to be bound by any changes GeekABC may reasonably make to this Agreement when such changes are made. If you have purchased Services or Solution from GeekABC, the term of this Agreement shall continue in full force and effect as long as you take advantage of and use the Software or Services. In the event you terminate your usage, GeekABC will not refund any amounts you have paid. You agree that GeekABC shall not be bound by any representations made by third parties who you may use to purchase Products and Services from GeekABC, and that any statement of a general nature, which may be posted on GEEKABC’s Web site or contained in GeekABC’s promotional materials, will not bind GeekABC. GeekABC may, at times, offer certain promotions with different charges and features. You agree that you will be responsible for notifying GeekABC should you desire to terminate your use of GeekABC’s Products and Services. Notification of Your intent to terminate must be provided to GeekABC no earlier than 15 days prior to your billing date but no later than three days prior to your billing date.
Limitation of Liability: GeekABC may participate as a “service reseller” or “lead reseller”. Customer agrees that it will not hold GeekABC, responsible for the actions or inactions of other resellers participating within the GEEKABC Services Network (GSN) program. Customer acknowledges that the GeekABC and its web site is nothing more than a venue to participate buy services. In the event a customer has a dispute with service network partner, Customer and service network partner agrees to release GeekABC’s officers, employees and agents from any and all claims, demands and damages (direct and indirect) of every kind, known and unknown, suspected and unsuspected, and disclosed or undisclosed. GeekABC does not guarantee the quality, safety or sufficiency of the services provided by GSN Partner.
No Third Party Beneficiaries: Nothing in this Agreement, express or implied, is intended to confer upon any third party any rights, remedies, obligations, or liabilities under or by reason of this Agreement, except as expressly provided in this Agreement.
Payment by Check: By using GeekABC’s pay by check option (“Pay By Check”), You can purchase GeekABC Products and Services using a personal check. In consideration for the Products and Services purchased by you and provided to you by GeekABC, you agree to allow our Check Services Partner (Intuit) to debit the full amount of this transaction from your checking account, which is non-refundable. Intuit will create an electronic funds transfer (EFT) or bank draft which will be presented to your bank or financial institution for payment from your checking account. The checking account must be at a financial institution in the United States, and the check must be payable in U.S. dollars.
It is your responsibility to keep your checking account current, and to have available funds in it. You agree that check service partner and GeekABC will not be responsible for payments that fail to go through as a result of your checking account no longer existing, or holding insufficient funds. If for any reason Intuit is unable to withdraw the full amount owed for the Services provided, you agree that Intuit and GeekABC may pursue all available remedies in order to obtain payment. You agree that if the EFT or bank draft is returned unpaid, you will pay a service charge of $35.00 or the maximum amount allowed by law, which may be debited from your account using an EFT or bank draft.
The check may not be for less than the full amount required at that time. Personal checks under $1,000 are subject to the same processing fees as wire transfers. All personal checks may be delayed up to fourteen (14) days until the money is credited, which may delay your usage of the Products or Services.
Remote Services Terms and Conditions: GeekABC will attempt to diagnosis your technology problem, provide an estimate of applicable service fees (plus applicable taxes), and then provide you with a technology solution via the Internet. In certain cases, however, problem diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control. You understand and agree that prior to contacting or allowing GeekABC to perform diagnostic repair or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that GeekABC shall not be responsible under any circumstance for any loss or corruption of data and/or software.
- Terms and Conditions for Help Desk (HD)
& GEEKABC Global Network Operations Center (G2-NOC)
GeekABC agrees to provide, and customer (“Buyer”) agrees to accept, this Service Agreement subject to the following terms and conditions.
HD and G2-NOC Services: Services will be provided during the Principle Period of Service (“PPS”), which is defined as that period of time 24-hours a day, Monday through Sunday, Holidays included. (7x24x365), or Monday through Friday, holidays excluded. (9x5)
- Support Services: At Buyer’s request, GeekABC will, during the PPS, provide telephone support to Buyer designated staff supporting the defined units. Our highly skilled and experienced Engineers will service incident calls placed with GeekABC . GeekABC shall not be obligated under any circumstance to engage any vendor or other third party, obtain incident ticket, or other manufacturer support services unless authorized to do so by the Buyer. GeekABC shall use reasonable efforts to utilize the resources available to discretion to provide quality responsible support services.
General Limitations: Services are not intended as consulting, design or implementation.
Exclusions for all applications and/or systems not supported by a GeekABC service agreement the Buyer is solely responsible for working directly with the manufacturer or software vendor for support services. Failures caused by viruses, user abuse and environmental conditions are the responsibility of the customer.
Responsibilities of the Buyer: Buyer shall provide GeekABC Solutions with full access and availability to the equipment to perform services as requested under this agreement and ensure that any and all documentation required to support custom applications, gain access, or apply remediation is furnished. Buyer is responsible to implement safeguards necessary to provide contracted services.
- General Terms and Conditions:
Consequential Damages: In no event shall GeekABC assume any liability for indirect, special, incidental, or consequential damages of any kind whatsoever, including, without limitation, lost profits, Business interruption, or loss of data, whether any claim is based upon theories of contract, negligence, strict liability, tort, or otherwise.
GeekABC reserves the right to refuse, suspend or terminate any services, promotions or products without prior notice. Initial diagnosic and travel fees may apply for all on-site and off-site service calls. This advertisement is subject to terms and conditions on GeekABC's website. Total computer fix includes a 90 day warranty on labor, not including parts, data recovery, data backup and data migration.
